Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Voicely Language ("the App") or visiting voicelylanguage.app ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Site.

These Terms constitute a legally binding agreement between you and Mervine Gowry, the operator of Voicely Language ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use Voicely Language. By using the App, you represent that you meet this age requirement. If you are under 18, you must have your parent or guardian's consent.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at legal@voicelylanguage.app if you suspect unauthorised access to your account.

You may not create accounts on behalf of others, share your account, or use the App for any commercial purpose not expressly permitted by us.

4. Subscriptions and Billing

Voicely Language offers a free 14-day trial and paid subscription plans (Pro and Premium). Subscriptions are billed through the Apple App Store and managed through RevenueCat.

• Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation must be done through your Apple ID subscription settings. We cannot process cancellations directly.
• No refunds are provided for partial billing periods, except as required by applicable law or Apple's refund policies.
• Prices may change with reasonable notice. Continued use after a price change constitutes acceptance.

5. Free Trial

If you begin a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. Cancellation during the trial will not result in any charge.

6. Voice Data and AI Features

Voicely Language uses voice recordings to create a personalised AI voice clone (powered by ElevenLabs) and to assess your pronunciation (powered by Microsoft Azure). By using these features, you consent to the collection and processing of your voice data as described in our Privacy Policy.

Your voice clone is for your personal use within the App only. You may not extract, copy, or use it for any other purpose.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or disassemble any part of the App.
• Circumvent, disable, or interfere with security features.
• Use automated tools to scrape, extract, or interact with the App.
• Impersonate any person or entity.
• Upload content that is illegal, harmful, threatening, abusive, or infringes third-party rights.
• Attempt to gain unauthorised access to our systems or other users' accounts.

8. Intellectual Property

All content in the App and Site — including the Voicely Language name, logo, HEXI™ design, FP Rings™ framework, curriculum content, and software — is owned by or licensed to us and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial language learning. This licence does not include any right to reproduce, distribute, or create derivative works from our content.

9. User Content

Content you submit through the App (including voice recordings and practice responses) remains yours. By submitting it, you grant us a limited licence to use it solely to provide and improve the App's features for you. We do not claim ownership of your content.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or free of viruses or harmful components. Language learning outcomes vary by individual and are not guaranteed.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account at any time if you breach these Terms, with or without notice. You may delete your account at any time from the You tab in the App (Settings → Delete Account).

Upon termination, your right to use the App ceases immediately and your data will be deleted per our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notice. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Voicely Language operates, without regard to conflict of law principles. Disputes shall be resolved in the competent courts of that jurisdiction.
